Wireless Broadband & Wireless Landline Terms & Conditions
These terms and conditions are in addition to our consumer terms and conditions, which also apply. A 12 month minimum term applies to all Amplio Wireless Broadband and Wireless Landline plans.
1) Equipment and Installation
1.A) Amplio Wireless Broadband requires a wireless modem, which is provided to you free of charge. Amplio Wireless Broadband is a service that is only available in 3G, 4G & 5G coverage areas within Auckland areas with sufficient capacity.
1.B) Installation of the Wireless Broadband modem can be performed by you (the customer) using the instructions supplied with the modem. Once the Wireless Broadband modem has been activated, you can contact us if you are having issues. We can then perform additional checks to test whether there is sufficient coverage for the service to work in your area. If there is insufficient coverage, you may return the product within 14 days. You can do this by contacting Amplio , we will collect the modem and SIM card. You may not use this SIM card in any other device. It remains our property and you must return it to Amplio on request. Once installed, you are responsible for the care and maintenance of the modem. If you experience any issues or have questions, you are able to contact us and receive our call- out service, we will do our best to resolve any problems.
1.C) You can only use your Amplio Wireless Broadband modem at the location that you have specified upon signing up for Amplio Wireless Broadband. Our suppliers manage their network to seek to provide our customers with a reliable and consistent service. If Amplio or our suppliers identify that you have used the modem at any address other than the specified location, we may terminate the services at our sole discretion. If you would like to use the Amplio Wireless Broadband modem in another location, please call us and will inform you if this request is possible or not.
1.D) If you are moving to a location outside of an Auckland area with sufficient capacity, you will need to terminate your contract with us. Early termination charges will apply. The Amplio Wireless Broadband modem requires mains power. In the event of a power failure, service will not be available, including landline calling to emergency services.
2) Wireless Broadband and Wireless Landline services
2.A) Amplio only supports a minimum 12 month term. New connections are subject to credit checks. Early termination charges and plan transfer fees may apply unless otherwise stated. If you disconnect or downgrade to a lower value broadband before the fixed term's end date of the 12 month minimum term, the termination fee starts at $300 and reduces by $50 on a three monthly basis to a minimum of $50. Data usage is measured in 10KB blocks, rounded upwards at the end of a data session or every 20 minutes, whichever comes first. Usage outside of your data bundle allocation is charged at $25 for 15GB or $40 for 50GB. Any unused data within a monthly data bundle will not be carried forward to the following month. The Amplio Wireless Broadband service excludes activities such as auto dialing, telemarketing, call centers, and using Cellular Trunking Units (CTUs). Amplio Wireless Broadband service is not able to be used as a gateway server. Your first bill will include part month charges plus a month in advance.
2.B) Our control of data speeds is limited to our suppliers network. Our policy is to provide you with the best broadband experience possible. In some circumstances our supplier may be required to take reasonable action in relation to any of the services Amplio provides in order to protect our customers and effectively manage the network we use.
2.C) The statements made about the broadband speed are not guarantees about continuous speed. Where a download or upload speed is specified, the Broadband Services are capable of burstable speeds up to the speed stated.
2.D) Due to coverage and tower capacity, we reserve the right to change your 5G/4G connection to a 4G/3G network in order to provide you with improved speeds.
2.E) All traffic, both upload and download, will be counted toward your data usage. Where a download or upload speed is described as “maximum”, you will receive the highest speed your broadband connection can deliver. The actual speed your Broadband connection can achieve may depend on a number of things including the condition of your line, the distance from the exchange, the equipment you use (including your computer), the time of day you are connecting, and the Internet use by others connected to the Network at the same time as you.
2.F) Calling over Amplio Wireless Broadband requires mains power and broadband coverage to operate. If power is not available, for example during a power outage, Wireless Broadband and any services which run over it, including voice calling through your landline, which includes calls to Emergency 111 services may stop working unless you have a power backup system in your home.
2.G) Services that require a traditional landline to work, such as fax machines or the interactive features of Sky Digital are currently incompatible with Amplio Wireless Broadband. If you have a monitored home alarm or medical alarm, you’ll need to check with your alarm company whether your alarm needs to be upgraded (or reset) from one that uses a traditional landline to one that will work over mobile or Broadband.
2.H) If you wish to port your existing phone number to your Amplio Wireless Broadband and Wireless Landline plan it will take up to 7 days to complete. The port will occur up to 7 days after the installation. Until the port is completed your existing phone service will continue to work and you will be billed for this period. You may be charged early termination fees or other charges by your existing service provider. Once the port is completed both your Amplio Wireless Broadband and Wireless Landline will be activated.
2.I) Each call is charged at the rate which is applicable when the call starts.
2.J) Local landline and national landline calls are included in the Broadband and Landline plan. National mobile calls are charged at 36c per minute. Please see our calling rates.
2.K) Calls are included for up to two hours at any time. Calls in excess of the two hour per call cap will be charged on a per minute basis thereafter in accordance with your calling plan. If you are calling an overseas mobile it will cost the same as the per-minute rate for that destination. There is a one minute minimum charge for all Wireless Landline calls. Thereafter, your call will be charged by the second.
2.L) Special numbers, 0900, 059, 0161, directory assisted calls, calling card access numbers, audio conferencing calls, will be charged at the applicable per minute rate of your calling plan. Calling features are billed on a monthly basis in advance on your billing cycle. If you cancel these services part way through the month you will still be billed to the end of your billing cycle. Amplio does not offer voicemail services as this feature is built into most modern home phone calling sets.
3) Fair Use Policy for Unlimited 3G, 4G & 5G
3.A) If your usage of our services materially exceeds estimated use patterns over any month, or is inconsistent with normal usage patterns, then your usage will be excessive and/or unreasonable.
3.B) If your usage is excessive and/or unreasonable we may contact you to advise you that your usage is in breach of our Fair Use Policy. We may then request that you stop or alter your usage to come within our Fair Use Policy.
3.C) If your excessive or unreasonable usage continues after receipt of a request to stop or alter the nature of such usage, we may without further notice, apply charges to your account for the excessive and/or unreasonable element of your usage; suspend, modify or restrict your use of the services or withdraw your access to the services.
