Business Wireless Broadband & Wireless Landline Terms & Conditions

1) General  

1.A) Your Business Wireless Broadband service will consist of the arrangements set out in the following agreement; 

1.B) These terms and conditions are in addition to our Business Terms and Conditions, which also apply. Our agreement to provide Business Wireless Broadband Service to you is conditional on us confirming that we are able to supply Access to your Site(s), and your confirmation to meet any additional costs or terms that may apply.

2) Location and equipment

2.A) You can only use your Amplio Wireless Broadband modem at the location that you have specified upon signing up for Amplio Wireless Broadband. Our suppliers manage their network to seek to provide our customers with a reliable and consistent service.  If Amplio or our suppliers  identify that you have used the modem at any address other than the specified location, we may terminate the services at our sole discretion. If you would like to use the Amplio Wireless Broadband modem in another location, please call us and will inform you if this request is possible or not. 

2.B) The modem/router contains a SIM card. You may not use this SIM card in any other device. For the avoidance of doubt this includes, but is not limited to mobile phones, tablets and other 4G/5G devices. If we identify that you are using your SIM in another device, we may ask you to return the SIM to the provided device, or restrict/cancel your service. The SIM remains the property of Vodafone and must be returned on request.

2.C) If you are moving to a location outside of an Metro-Auckland area with sufficient capacity, you will need to terminate your contract with us. Early termination charges will apply. The Amplio Wireless Broadband modem requires mains power. In the event of a power failure, service will not be available, including landline calling to emergency services.

3) Traffic management

3.A) Use of your Wireless Broadband Service is subject to our Fair Use Policy. Our control of data speeds is limited to our suppliers network.  Our policy is to provide you with the best Broadband experience possible. In some circumstances our supplier may be required to take reasonable action in relation to any of the services Amplio provides in order to protect our customers and effectively manage the network we use. 

3.B)Our suppliers reserve the right to manage traffic at peak times to improve the overall performance and experience among our customers. In particular, they reserve the right to prioritize specific types of traffic over other traffic at times of congestion (and for limited time periods) where they consider there will be significant customer interest in the specific type of traffic and prioritization is necessary to ensure customers receive an acceptable experience.

3.C) Due to coverage and tower capacity, we reserve the right to change your 5G/4G connection to a 4G/3G network in order to provide you with improved speeds.

4) Wireless Landline services

4.A) If you wish to port your existing phone number to your Amplio Wireless Broadband and Wireless Landline plan it will take up to 7 days to complete. The port will occur up to 7 days after the installation. Until the port is completed your existing phone service will continue to work and you will be billed for this period. You may be charged early termination fees or other charges by your existing service provider. Once the port is completed both your Amplio Wireless Broadband and Wireless Landline will be activated.

4.B) There is a maximum of one Wireless Landline service with each Business Wireless Broadband Plan. Calling over Amplio Wireless Broadband requires mains power and broadband coverage to operate. If power is not available, for example during a power outage, Wireless Broadband and any services which run over it, including voice calling through your Wireless Landline services, which includes calls to Emergency 111 services may stop working unless you have a power backup system in your home.

4.C) We will provide you with a modem/router. The modem holds secure configuration information required for your Wireless Landline services to work on our network. Your Wireless Landline services will not work with any other router.

4.D) Wireless Landline services are compatible with standard analogue and DECT phones only. IP handsets are not supported. Phones or their base station must be plugged into the allocated port on the back of the supplied router. 

4.E) Services that require a traditional landline  to work, such as fax machines or the interactive features of Sky Digital are currently incompatible with Amplio Wireless Broadband. If you have a monitored home alarm or medical alarm, you’ll need to check with your alarm company whether your alarm needs to be upgraded (or reset) from one that uses a traditional landline to one that will work over mobile or Broadband. Business Wireless Broadband may not be compatible with Alarm Line Monitoring or as an emergency telephone service for locations such as elevators.

4.F) Your Wireless Landline service includes unlimited standard phone calls to New Zealand landlines (“Included calls”). Included calls are standard person-to-person calls to New Zealand landline numbers.

4.G) Your Wireless Landline service does not include: calls to New Zealand mobiles, satellite services, premium or special numbers, international calls or Excluded calls.

4.H) Any calls not covered by your Wireless Landline service will be charged at the rates set out in the Calling Rates or otherwise notified to you. 

4.I) All Chargeable calls are charged on a minute plus minute basis (calculated to the next minute). There is a one minute minimum charge for each call and the charge for each call is rounded to the nearest cent.

4.J) Chargeable calls to some countries have a ‘capped rate’ as outlined in the Calling Rates. For these countries, calls are charged on a minute plus minute basis up to the cap specified for a 2 hour call. If you remain on the call after 2 hours, your call will be charged at a per minute rate for the remainder of your call.

5) Service Limitations

5.A) You may not use Wireless Broadband services:

5.A.1) for contact centers, tele sales, auto-dialing, continuous call forwarding, telemarketing or multiple simultaneous calling or any other activity that we consider to be non-standard usage; or

5.A.2) for resupply, resale, on-sale or any other supply to a third party (whether in whole or in part).

5.A.3) We may decline to supply you with Wireless Broadband services, or suspend or terminate your Wireless Broadband service (in whole or part) if we consider that your use or a User’s use of your Wireless Broadband service is not in accordance with our Business Terms and Conditions. 

6) Your responsibilities 

6.A) Unless there is a separate agreement in place between you and us to the contrary, the internal security of your IT and telecommunications networks is your own responsibility. You will maintain strong password strength for all aspects of your LAN network and voicemail password protection to protect your business from malicious attack.

6.B) You are responsible for:

6.B.1) any required operating system configuration on your computer and connecting any local area network or computer network to the Wireless Broadband service;

6.B.2) local area network or computer equipment and any related cabling;

6.B.3) ensuring that your existing computer and other equipment at your site(s) is working properly and can support your Wireless Broadband

6.B.4) any power required by equipment that we install to support the Wireless Broadband,

6.B.5) unless we provide any of the above items to you as a separate service.
